The European Commission said on Monday that it would refer Poland and Austria to the Court of Justice of the European Union for failing to fully transpose the EU’s Energy Performance of Buildings Directive into country law.

The EC also proposed daily penalties for both member states. In the case of Poland, the suggested penalty is €96,720, taking into account the duration and the gravity of the infringement, the commission explained.

Both Poland and Austria received formal notices on their failure to transpose the directive in September 2012. The countries however have not managed to complete the process since, the statement also reads.
