AI changing definition of authorship of graphics and text
Polish copyright law recognizes only humans as authors, creating major legal challenges as employees increasingly use generative AI to produce texts, code, graphics, and marketing materials. Content generated entirely by AI is generally not protected by copyright, meaning neither the employee nor employer gains original economic or moral rights to it. Protection may apply only when a worker makes significant creative decisions, edits, modifies, or combines AI-generated elements into a new original work.
Simple prompts are not protected, but highly complex, original prompts may qualify as literary works or even software-like creations. If created as part of employment duties, rights to such prompts usually transfer to the employer unless the contract says otherwise.
