Jastrzębska Spółka Węglowa (JSW) has requested a refund of the 1.6 billion PLN solidarity levy it paid in 2023, arguing it was the only company affected by the law targeting coal and coke producers with over 3,000 employees. The levy significantly impacted JSW’s finances—its 2023 net profit dropped to 997 million PLN from 7.6 billion PLN in 2022, and EBITDA fell by over half.

Additional pressures include falling coke coal prices, rising production costs, and weak global demand due to reduced steel output in China. JSW is implementing a Strategic Transformation Plan and seeks to cover a 6.3 billion PLN net loss for 2024 from reserve capital while hoping to recover the levy to improve stability.
