European Convention on Human Rights to be inconsistent with the Polish constitution

The Constitutional Tribunal, controlled by PiS (Law&Justice), ruled today that one of the provisions of the European Convention on Human Rights is unconstitutional. It guarantees everyone the right to a fair trial before an independent court.
Thus, the Constitutional Tribunal agreed with the prosecutor general Zbigniew Ziobro and for the first time in its history found that the European Convention on Human Rights is inconsistent with the Constitution. Therefore, he questioned one of the most important international agreements which guarantee citizens of 47 European countries many rights and freedoms.
"The convention is the most important document in the field of human rights in Europe. Its parties are almost all European countries (except Belarus and the Vatican). No serious European state can reject the provisions of the convention," Dr. Marcin Szwed from the Helsinki Foundation for Human Rights, said.
