UOKiK charges Google over publisher terms
Poland’s competition regulator UOKiK has charged four Google group companies with potentially abusing a dominant position in negotiations with Polish media publishers. The regulator says Google may have used its strength in internet search to impose unfavorable terms and failed to provide information needed to value content used in its services. UOKiK also noted that Google has not signed content-use agreements with most media companies in Poland.
The case covers Alphabet Inc., Google LLC, Google Ireland Limited and Google Poland. UOKiK says Poland’s 2024 copyright-law amendment implementing the EU’s DSM directive strengthened publishers’ rights to remuneration when digital platforms use articles or excerpts. The regulator will examine responsibility for each company during proceedings. If abuse of dominance is established, the maximum penalty can reach 10 percent of a company’s turnover. Google has not yet been found liable in the case.
