Decisions made during PRL may affect up to 100,000 premises
Up to 100,000 apartment owners may be affected by unresolved land rights beneath older housing blocks. During the communist era, cooperatives built estates on state-owned plots, but many titles were never finalized. The problem usually appears when owners try to sell, obtain a mortgage, or establish a land and mortgage register. Without clear land rights, banks may refuse financing, leaving owners with mostly cash buyers.
Government estimates put the problem at about 100,000 rights holders in 120 cooperatives, especially in Warsaw. Bill UD335 would create a faster administrative procedure, allowing cooperatives to claim perpetual usufruct of the land and ownership of the buildings. It is not yet law and would not make residents landowners, but may unblock registration and mortgages.
