EC brings action against Poland before CJEU

The European Commission (EC) has decided to submit a complaint to the Court of Justice of the EU (CJEU) regarding a new system of disciplinary measures against judges in Poland and to ask it for an accelerated hearing. The Commission has initiated infringement proceedings because it claims the new system of disciplinary measures undermines the independence of judges in Poland and does not provide the necessary safeguards to protect them against political control, as required by the CJEU.

“The Polish law allows ordinary court judges to be subjected to disciplinary investigations, procedures and sanctions on the basis of the content of their judicial decisions, including the exercise of their right under Article 267 of the Treaty on the Functioning of the European Union (TFEU) to request preliminary rulings from the Court of Justice of the EU,” the EC stated.
