Poland’s Ombudsman is receiving more complaints about disputes between landlords and tenants, Ombudsman Marcin Wiącek told Rzeczpospolita. Some landlords claim that dishonest tenants are abusing tenant-protection rules to delay or block eviction, even after lease agreements have been legally terminated.

According to Wiącek, some owners are unable to evict tenants for years while receiving no rent and still covering the costs of maintaining the apartment. In some cases, the property is financed with a mortgage that was meant to be repaid from rental income, creating serious financial pressure. Other owners cannot return to their own apartments because tenants refuse to leave or pay.

Wiącek criticized the government’s response, which pointed mainly to court delays. He argued that the right to a court also includes enforcing final judgments, which can be impossible when municipalities fail to provide social housing for evicted tenants.
