Planned excise tax hikes on e-cigarettes and vaporization devices could lead to the withdrawal of some products from the market. Experts highlight multiple irregularities in the legislative process, raising concerns about the legal implications.
"I doubt whether this tax change is proportional to the intended effects. The regulation may violate key legal principles such as proportionality and equality before the law," Dr. Hab. Krzysztof Koźmiński, head of the Regulatory Impact Assessment Center, said.
He also pointed out that the short grace period could make it difficult for businesses to adapt.
The proposed changes include drastic excise increases on select nicotine products, potentially driving many businesses out of the market due to a lack of profitability. Moreover, the rapid implementation timeline could leave entrepreneurs without sufficient time to adjust or shift their operations, further intensifying the industry's challenges, warned Koźmiński.
