New rules for hiring foreigners

Updated regulations simplifying the employment of foreigners in Poland came into force on June 1. Two laws—one streamlining work legalization, the other tightening visa oversight—aim to curb abuse while increasing employer accountability.
Key changes include mandatory digital procedures via praca.gov.pl, elimination of the labor market test, stricter reporting timelines, and added penalties. Employers must now send contracts electronically, report early job terminations, and notify authorities of employment changes within two months (previously three).
New grounds for permit refusal apply to certain visa types, and outsourcing arrangements face restrictions. Temporary work agencies must operate for two years before hiring foreigners and pay a PLN 1,000 fee unless already registered by June 1, 2025.
Fines have increased sharply, with potential penalties of up to PLN 50,000 per undocumented worker. Experts warn employers to stay compliant and seek legal guidance to avoid costly errors.
