Child benefit gap after parent's death

Deputy Commissioner for Human Rights Stanisław Trociuk highlights an issue with accessing educational benefits for children without appointed legal guardians following a parent's death. In a case presented to the Minister of Family, Labour and Social Policy, a minor boy’s parents died, and his grandmother took over his care.
After the boy’s father's death in October 2022, the family continued receiving the 500 plus benefit until November 2022. When the grandmother became the legal guardian in April 2023, she applied for child benefits, which were only granted from the date of her official guardianship. From the father’s death until the guardianship was established, no benefits were provided due to the absence of a legal guardian during that period.
