The European Commission plans to close its rule of law procedure against Poland. Ursula von der Leyen, the Commission's President, announced that a new chapter begins for Poland, as the Article 7 procedure can be closed after more than six years. She praised Polish Prime Minister Donald Tusk and his government for their hard work and reforms.
The Commission assessed Poland's situation and found no clear risk of serious violation of the rule of law. Poland took steps to address judicial independence concerns and recognized the primacy of EU law, following all relevant EU and European Court of Human Rights rulings.
Poland's Plan of Action from February 2024 and its membership in the European Public Prosecutor's Office were crucial in the Commission's decision. The Commission plans to withdraw its proposal from 2017 and will inform the Council and European Parliament of this decision.
