EU Tobacco Law Reform Sparks Controversy in Poland Over Regulation and Taxation

The European Commission is preparing a new directive to unify tobacco product regulations across the EU, sparking debate among Polish MEPs. The proposal includes a potential ban on e-cigarettes, restrictions on nicotine pouch flavors, and a sharp increase in excise duties – measures aimed at curbing illicit trade and protecting public health. However, critics warn the changes could backfire.
Elżbieta Łukacijewska (Civic Platform) cautions that a steep tax hike could fuel the black market, undermining both health and fiscal goals. Anna Zalewska (Law and Justice) denounces the plan as overregulation and fears overlapping EU and national laws could cause legal chaos. Poland’s Ministry of Health recently proposed its tightening of tobacco rules, including a total ban on e-cigarettes, raising concerns about inconsistent policymaking.
With the tobacco sector contributing 6 percent of Poland’s GDP and facing rising smuggling from the east, MEPs argue that local realities must shape EU decisions.
