Poland’s antitrust authority (UOKiK) accuses popular shopping platform Temu, owned by Irish company Whaleco Technology Limited, of price manipulation and misleading discount practices. The platform allegedly failed to comply with the EU’s Omnibus Directive, which requires showing the lowest price from the past 30 days when advertising a discount.

Temu’s prices changed frequently, but the reference “lowest price” remained static, potentially deceiving consumers. UOKiK warns this could mislead shoppers into overpaying during seemingly attractive sales. The company faces a fine of up to 10% of its global turnover. However, enforcing penalties may be challenging due to cross-border jurisdiction. UOKiK may also require corrective actions, including clearer pricing and publishing the decision within Temu’s app and website.
