Businesses: liquidation of civil contracts will devastate labor market

Poland’s Ministry of Family, Labour and Social Policy has proposed granting the State Labour Inspectorate (PIP) the power to reclassify civil law contracts (mandates, freelance, B2B) into employment contracts, even retroactively. Employers’ organizations strongly oppose the plan, warning it could devastate the labor market, violate contractual freedom, and raise costs through back taxes, ZUS, and other contributions. Sectors relying on flexible work—such as IT, media, culture, gastronomy, and education—would be most affected.
Critics argue the reform could spark legal and economic chaos, harm competitiveness, and push workers into the grey economy. They also highlight heavy tax consequences for the self-employed. Business groups demand broad consultations or withdrawal of the project.
