CJEU: judgments of Court binding national courts

“A preliminary ruling binds a national court in resolving a dispute,” said the Court of Justice of the EU (CJEU) on Friday, referring to the decision of the German Federal Constitutional Court.
In a Tuesday ruling, the German Constitutional Court objected to the judgment issued by the Court of Justice of the EU in December 2018 approving the activities of the European Central Bank under the government bond buying program since 2015. This is the first time that the Federal Constitutional Court has found that the actions and decisions of EU bodies were contrary to European competence rules. Therefore, according to FTK, they have no legal force in Germany.
In turn, the European Commission confirmed the primacy of EU law over national law, announcing a detailed analysis of the German ruling.
