WIBOR on docket with Court of Justice of the EU to determine loan installments

The year 2025 could be pivotal for Polish mortgage borrowers, as the EU Court of Justice (TSUE) will rule on the legality of WIBOR-based loan practices. The case, led by a firefighter, highlights lack of transparency in mortgage agreements, not financial speculation. WIBOR, which determines interest rates on most PLN loans, is based on banks’ estimates rather than actual interbank transactions, a fact many consumers were never clearly informed about.
If TSUE rules that banks misled clients, consequences could mirror the Swiss franc loan crisis: removing WIBOR from contracts, lowering installments, refunds of overpayments, and mass lawsuits. Experts stress that borrowers should review their contracts, seek legal advice, and secure documentation. A verdict is expected in September 2025.
