The government has withdrawn the regulation requiring employers to enter into employment contracts with foreign workers. The Council of Ministers approved a package of bills related to foreigners. At the request of the Ministry of Development and Technology, provisions mandating the employment of foreigners exclusively through employment contracts, which had been highly criticized by businesses, were removed.
The government’s decision to withdraw the mandatory employment contract requirement for foreigners is a step in the right direction, as it helps avoid inequality and unnecessary burdens for both employers and foreign workers. It is essential to remember that freedom in contract arrangements is a key element of a well-functioning labor market. Poles and foreigners should have the option to choose the form of employment that best suits their needs and life circumstances.
“Introducing a requirement for employment contracts only could paradoxically reduce income stability in situations where other forms of collaboration, such as mandate contracts or B2B agreements, offer greater flexibility and meet the actual needs of both workers and employers,” Yuriy Grygorenko, Chief Analyst at Gremi Personal, commented.
