President Andrzej Duda presented the draft amendment to the Act on the Establishment of the State Commission for Investigating Russian Influence on the Internal Security of the Republic of Poland in the years 2007-2022, also known as "Lex Tusk."
The presidential draft includes three significant changes. The first one concerns the composition of the commission, which until now was supposed to consist of parliamentarians.
"This commission should be above elections; we don't need a commission for elections. We need a commission that will act and thoroughly explain this matter," he said.
The second change concerns the appellate route. In the presidential draft, the Appellate Court in Warsaw was designated as the appropriate authority.
The third very significant change concerns the so-called remedial measures. According to the currently effective law, the commission can impose such measures, and one of them would be a ban on holding certain state positions, including the position of the Prime Minister.
“Participating in elections is the right of every citizen, which is why I propose to remove remedial measures. In the draft amendment, the statement of the commission on Russian influence will be that a person 'does not provide a guarantee of proper performance of duties in the public interest'," said the President.
