UOKiK imposes PLN 7 mln on two companies from RES industry
The President of Poland’s competition authority (UOKiK) imposed fines totaling over PLN 7 million on Energia dla Pokoleń and Polska Energia Grupa Kapitałowa for unfair contract clauses and misleading marketing practices. Proceedings are also ongoing against another company, Nasz Prąd.
UOKiK found that Energia dla Pokoleń used contract terms that could limit consumers’ ability to enforce their rights, particularly regarding installation deadlines. Vague wording such as “unfavourable weather conditions” made it difficult for customers to determine whether delays were justified. This could leave them waiting indefinitely without effective recourse. The authority also noted inconsistencies between promised benefits and contractual disclaimers. Companies advertised specific energy savings but did not guarantee actual performance.
Additionally, complaints revealed cases where installed components differed from those presented during the sales process. Companies argued that visual materials were not binding.
Polska Energia Grupa Kapitałowa was criticized for using advertisements resembling official notices, which could mislead consumers and pressure them into quick decisions. These materials also exaggerated electricity price increases, claiming rises of 300–400%, while actual increases were below 33%.
UOKiK is also investigating Nasz Prąd for clauses allowing high penalties for delays under unclear conditions.
