Borrowers give up CHF processes for fear of high costs
According to Anna Lengiewicz, managing partner of LWB Lengiewicz Wrońska i Wspólnicy, in court cases related to the so-called Polisoly deposits and Swiss franc loans, the chances of winning with the bank are as high as 80-90 percent. However, most consumers do not take any steps to get their money back for fear of losing more money to pay for lawyers and court fees.
"Consumers are afraid of pursuing their rights against financial institutions, banks, and insurance companies, mainly because they do not want to lose more money on compensation offices, lawyers, high costs of proceedings, and court fees. The second reason is the fear of confronting huge corporations such as financial institutions. Banks and insurance companies have enormous capital and a lot of lawyers, and the common consumer is naturally afraid of losing. It can be compared to David's fight with Goliath," Anna Lengiewicz said.
This month, the RePlan program was launched, which provides funding for cases brought against banks. The borrower can count on legal services and full coverage of the costs of the proceedings, and he will pay the remuneration only if the case is won.
The RePlan program is an investment of an American private equity fund worth approximately PLN 150 million.
