The ClientEarth Foundation has initiated a groundbreaking lawsuit against the Polish government, representing two asthma patients – a 55-year-old man from Rybnik and a five-year-old boy from near Toruń. The plaintiffs allege that governmental inaction on air pollution has directly harmed their health. They are seeking compensation totaling PLN 300,000 for health damages and reimbursement for medical expenses.
"We expect the court to confirm the link between deteriorating health and poor air quality in Poland, and to award compensation for the harm suffered due to air that, firstly, does not meet standards, and secondly, has caused health damage," Agnieszka Warso-Buchanan, legal counsel and board member of ClientEarth, emphasized.
This lawsuit marks the first time a Polish court will assess the direct connection between air pollution and serious health conditions. The outcome could set a precedent for future environmental litigation and influence national policies on air quality management.
