Polish courts may soon face another serious challenge as interest grows in lawsuits related to the WIBOR benchmark used in złoty-denominated loans. Experts warn that a surge in such cases could further overload an already strained judiciary, potentially leading to paralysis similar to the wave of Swiss-franc mortgage litigation. While banks could reduce risks by proposing contract changes or settlements, observers doubt consumers will be offered favorable terms. Specialists also caution against pseudo-legal firms using misleading marketing to encourage lawsuits without explaining risks.

Structural problems — especially staff shortages — already delay hearings by years. Some experts argue WIBOR cases are not a systemic issue and will not match the scale of franc loans, but call for specialized financial court divisions to handle disputes more efficiently and prevent wider disruption.
