Polish president signs amendment on pursuing class action lawsuits for consumers

President Andrzej Duda has signed an amendment to Poland’s class action law to align with EU Directive 2020/1828. This update allows designated consumer protection organizations and the Financial Ombudsman to file class actions against businesses. Key changes include expanding the types of cases that can be addressed, such as harmful practices affecting consumer interests, and allowing these entities to demand various remedies, including compensation or contract cancellation.
Additionally, the amendment introduces penalties for defendants who delay compliance, with fines up to PLN 5 million and daily fines up to PLN 50,000 for delays. The new regulations will take effect 14 days after the announcement.
