Developers: judgement at CJEU will not stop housing market
The Court of Justice of the EU (CJEU) ruling on WIBOR-based loans should not significantly disrupt Poland’s housing market, according to Bartosz Guss of the Polish Association of Developers. The judgment does not automatically invalidate mortgages linked to WIBOR; instead, each contract must be assessed individually by Polish courts. While the decision may create a temporary period of legal uncertainty until a consistent line of case law emerges, it is unlikely to affect apartment sales directly.
Demand remains primarily driven by interest rates, housing prices, credit availability, and overall macroeconomic conditions. With relatively high housing supply and falling mortgage rates, demand could gradually recover. However, banks are expected to continue operating under elevated legal risk until court practice stabilizes.
