Government adopts draft amendment on Construction Law; notifications instead of permits

A new amendment to Poland’s Construction Law, approved by the Council of Ministers, aims to simplify and accelerate building procedures by reducing red tape. Under the proposal, certain structures—including freestanding home shelters (up to 35 m²), covered terraces (up to 50 m²), sports fields, and small public-use buildings—can be built without a building permit, requiring only a simple notification.
Farmers will be allowed to build water reservoirs, pools, and ponds (up to 50 m²) without permits. The law also eases installation rules for small-scale renewable energy systems. A new "yellow card" mechanism will allow minor noncompliance to be corrected without formal penalties. The deadline for mandatory digital construction records has been postponed to December 31, 2034.
