IGHP: regulations on Ownership of Premises alarming to hotel industry
A draft amendment to Poland’s Act on Ownership of Premises would significantly limit the creation of new condo-hotels by granting municipalities full discretion over whether individual units in collective accommodation buildings can be separated. Under the proposal, such separation would be allowed only if approved by a municipal council resolution, though existing projects and those permitted before January 2027 would be protected. The hospitality industry warns that the rules could curb investment, favor established players, push up prices, and increase speculative activity on the secondary market. Critics argue that broad municipal discretion risks legal uncertainty, potential abuse, and even constitutional challenges.
While the government says the aim is to combat “pathological development” practices, industry representatives caution that the changes may destabilize Poland’s aparthotel and condo-hotel market.
As the representative of the IGHP, Krzysztof Szadurski, emphasizes, these regulations will have a negative impact on the development of the hotel industry.
