Mirbud goes to court after KIO judgement and dispute over rail tender
Mirbud plans to appeal to the Court of Public Procurement against a ruling by the National Appeals Chamber (KIO) that excluded its consortium with Torpol from one of the largest rail contracts in Poland — the multi-billion-złoty upgrade of the Rail Baltica line between Białystok and Ełk.
KIO ruled that the consortium should be excluded because Mirbud failed to disclose a PLN 15,000 environmental fine imposed in 2022. Mirbud argues the decision is flawed and disproportionate, stressing that the fine was minor, publicly disclosed in its financial statements, related to a technical breach of an environmental permit, and does not constitute a serious violation of environmental law. The company also claims any potential grounds for exclusion had already expired by the time bids were assessed.
The tender, estimated by PKP PLK at around PLN 6 bln, has now been provisionally awarded to a consortium led by Budimex, though the court case will continue alongside the procurement process.
