Senate backs labor reform
The Senate has approved an amendment to the Act on the National Labor Inspectorate (PIP), with 57 senators voting in favor, one against and 31 abstaining. The bill now awaits the president’s signature.
The reform gives labor inspectors the power to convert sham civil law or B2B contracts into employment contracts through an administrative decision. Granting this authority is a milestone required for Poland to access funds from the National Recovery Plan.
If irregularities are found, inspectors may order employers to address cases where a civil contract effectively meets the criteria of employment, after hearing both parties. Failure to comply may trigger administrative proceedings led by a District Labor Inspector or a court case initiated by the worker.
The amendment also enables data sharing between PIP, ZUS and the tax administration, allows remote inspections and raises penalties for violations of employee rights. The law is set to take effect three months after publication.
