Legal issues with balconies leading to fines

The legal status of balconies in Poland remains unclear and has financial and legal consequences for property owners. Although balconies are typically for the exclusive use of the apartment owner, structural elements like the balcony slab and railings are usually considered part of the building’s shared property. This distinction affects who is responsible for maintenance and repairs, and what changes residents can make—like painting walls, laying tiles, or growing plants.
Disagreements often lead to conflicts involving neighbors, housing associations, and even courts. Violating regulations may result in fines (starting at PLN 500) and other costs. Court rulings confirm that balconies, despite private use, may still legally belong to the common property of the building.
