Huawei concerned with draft amendment to Poland’s law on national cybersecurity

Huawei Technologies Cooperatief U.A., which owns 90% of Huawei Polska, expressed concern over Poland’s draft amendment to the Cybersecurity Act, warning it could lead to the company’s exclusion from key market sectors. In a letter to the Prime Minister, several ministers, and the General Prosecutor’s Office, Huawei said the proposed rules on “high-risk suppliers” were discriminatory and unclear, potentially targeting non-EU or non-NATO firms.
Huawei argued the legislation could violate protections under the China–Poland Bilateral Investment Treaty and the Energy Charter Treaty (ECT), with potential losses in the billions of PLN. The company urged dialogue and reserved the right to initiate arbitration under Article 26 of the ECT, though it called this a “last resort.”
